Employer Supplemental Terms

These Employer Supplemental Terms ("Supplemental Terms") apply to your administrative access and use of employer.iontuition.com (the “Employer Portal”), and are in addition to the iontuition.com Terms of Use, which are incorporated herein by this reference. The term “Site” in the Terms of Use shall include the Employer Portal, and the term “Services” includes any service, feature, or content made available on or via the Employer Portal. Other capitalized terms used herein that are not defined have the meanings ascribed to them in the Terms of Use.

These Supplemental Terms constitute a legal agreement between you and IonTuition. BY ACCESSING AND USING THE EMPLOYER PORTAL YOU ARE ACCEPTING ALL OF THE TERMS AND CONDITIONS OF THESE SUPPLEMENTAL TERMS AND IONTUITION'S PRIVACY POLICY. YOU AGREE THAT THESE SUPPLEMENTAL TERMS ARE ENFORCEABLE LIKE ANY WRITTEN NEGOTIATED AGREEMENT SIGNED BY YOU. IF YOU DO NOT AGREE TO ALL OF THESE SUPPLEMENTAL TERMS, DO NOT USE THE EMPLOYER PORTAL.

1. Accepting the Terms
You represent that you have the capacity to be bound by these Supplemental Terms and by using or accessing the Employer Portal, you certify you are authorized to view confidential personally identifiable information (“PII”) associated with your organization’s employees and that you are authorized to manage payroll and benefit functions for your organization.

2. Information Privacy
For information about IonTuition's personally identifiable and non-identifiable data handling practices, please read the Privacy Policy available here.

You represent that you are authorized to upload your organization’s payroll and have received consent from all relevant employees, participating and not, to view their Account Information containing confidential PII on the Employer Portal and to upload employee eligibility files containing employee confidential PII to the Employer Portal. You agree that both participating and non-participating employees of your organization have consented to receive email notifications based on actions you have performed on the Employer Portal.

3. Description of the Services
The Services include a personal student loan information management service, IonPay, that allows you, as an employer, to perform functions involved in administering student loan payments on behalf of your employees participating via IonTuition.com. IonPay permits employees to elect for automatic payments via payroll deduction and repayment assistance from employers, through use of a third party payroll distribution solution.

You agree that we are not a payment processor and that a third party payroll distribution solution is responsible for compliance with all law applicable to payment processors, and for effectuating any wire transfer, debit, deposit, or money transmission request or service.

4. Access to Employer Portal
You agree that access to the Employer Portal is governed by the following terms:

You agree that by logging onto the Employer Portal, all information accessed through the Employer Portal is confidential and / or proprietary to IonTuition or to its clients. All such information must be held in confidence and may not be used or disclosed except as necessary in the furtherance of IonTuition’s business. Any violation of the above is subject to system access termination and further action up to and including potential civil and/or criminal liability. By logging onto the Employer Portal you are acknowledging the above and reaffirming your agreement to adhere to the policies and procedures applicable to your use of the Employer Portal.

If you become aware of any unauthorized use of your account, you agree to notify IonTuition immediately at the email address security@iontuition.com.

5. Account Information
IonTuition makes no effort to verify any Account Information you provide for any purpose, including accuracy, legality, or non-infringement.

6. Content
Notwithstanding anything to the contrary in the Terms of Use, you may only download a roster of your organization’s participating employees and upload your organization’s payroll file and employee eligibility files. You may not modify any portion of the Content.

7. Ending your Relationship with IonTuition
These Supplemental Terms will continue to apply unless terminated pursuant to this Agreement or any other Agreement with IonTuition.

If you want to deactivate your access to the Employer Portal, please write us at benefits@iontuition.com. Promptly upon receipt of your request, we will use reasonable efforts to remove data you provided to us or that we collected on your behalf from our servers subject to and as explained in our Services Agreement.
